In the US, “THE FREELANCE ISN’T FREE” Act, is a law that protects freelancers against non-payment. It requires a written contract between the freelancer and the client, timely and full payment as well as protection from full retaliation.
In India, all contracts and agreements are crafted along the lines of the Indian Contract of 1872 (yes, eighteen fucking seventy-two ). According to this act, a contract entails the name and addresses of the parties along with clear financial statements, the deadline for submission, and the date of commencement and termination of the project.
*It is important to note that without a written contract, the client isn’t liable to pay since there is no evidence that pays for the services rendered was agreed upon. Apart from the contract, the exchange of information between the client and the freelancer should be on email or text message so that there remains proof in case of a future dispute.
If you don’t enter into a contract with your clients, you will never have a strong case against them (and the possibility of you getting fucked over is way too high).

Freelance Project Agreement Example
The Parties
This Freelance Project Agreement (referred to as the “Agreement”) is made effective this [9th day of January 2021] by and between [Rozek Home Cleaning Inc.](referred to as the “Employer”), with its principal place of business at [4890 Shearwood Forest Drive, NH 03867], and [Mr. John G. Lamm] (referred to as the “Employee”) with its principal place of business at[1917 Milford Street, Londonderry, NH 03053].
The Employer and the Employee are each referred to as a “Party” and, collectively, as the “Parties.”
Services
The Employer engages the Employee to render work as a Freelance Social Media Marketing Manager for the rebranding project of the Employer.
The Employee shall manage the social media marketing and advertising campaigns involved in the Employer’s project to rebrand its company to increase its visibility in various social media platforms and establish a strong online presence.
The Employee shall perform the following duties under this Agreement:
- Coordinate with the Content Team to conceptualize, formulate, and produce high- quality written and visual social media content for the rebranding project.
- Monitor the performance of the posts related to the rebranding project.
- Cooperate with the Marketing Team in creating and implementing a marketing scheme to boost the presence of the rebranding project’s social media campaign.
Amount
By the Employee’s acceptance of this Agreement, the Employer shall compensate the Employee with [$1,500] monthly until the termination of this Agreement for its services and contribution to the completion of the Employer’s rebranding project.
The release of such monthly compensation shall follow a semimonthly pay schedule and shall be deposited or transferred to the Employee’s account [15th and 30th] day of the month.
Term & Termination
This Agreement is non-renewable and shall be effective on the [9th day of January 2021] and shall remain in effect for a term of [six (6)] months or until the [9th day of July 2021] only.
Provided that the terminating party forwards a notice of termination at least fourteen (14) days prior to the date of early termination, this Agreement may be terminated by either Party at any time before the end of its term for any of the following reasons:
- Failure of the Employee to perform or complete the work required under this Agreement.
- Voluntary resignation of the Employee prior to the termination date of this Agreement.
In the event of early termination of this Agreement, the Employee shall not be entitled to receive any early termination fee and shall not be eligible to receive the remaining amount of the Employer’s compensation. The Employee, however, shall be eligible to receive its last pay for the month.
Warranties
The Employer warrants to the Employee the provisions of support, necessary information, resources, and equipment to perform the work required, granted that the employee agrees to keep all resources and equipment remain in good condition and return such resources to the Employer [five (5)] days prior to the termination of the this Agreement.
All information and documents related to this Agreement and the Employer’s project shall remain the sole property of the Employer. The Employee acknowledges that all information related to this Agreement and the Employer’s project is confidential and shall not be disclosed to any third parties without the prior written consent of the Employer.
General Provisions
Unless stated herein, both Parties shall indemnify and hold harmless the other Party from any losses or damages that may occur upon performing the obligations set forth herein.
This Agreement shall be governed by, and interpreted under, the laws of the State of New Hampshire. Any disputes arising between either Party upon the execution of this Agreement shall be subject to the competent jurisdiction of the local, state, or federal courts of said state.
Acceptance
IN WITNESS WHEREOF, each of the Parties has executed this Freelance Project Agreement as of the day and year set forth above.
